Compliance

At Professional Recovery Consultants, we understand the complex rules and regulations that control the collection process.  These regulations are not only hard to keep up with and ever changing, but can often prove frustrating and challenging to understand.  That's why we have formed our own internal compliance department to monitor and advise our staff of changes to legal and procedural aspects of the collections industry.

All of our collection policies and procedures are fully compliant with the Fair Debt Collection Practices Act (FDCPA), Health Insurance Portability and Accountability Act (HIPAA), Fair Credit Reporting Act (FCRA), and Gramm Leach Bliley Act.  Collectors who have been with us for at least 6 months go through ACA's Certified Collector program.  Once they have successfully completed the program, they receive ongoing training and incentives to help them understand the current laws and remain up-to-date on all applicable collection regulations.  In addition, our collectors are insured, licensed and bonded.  In December of 2008, PRC became PCI (Payment Card Industry) compliant.  We do not store credit card information on our system, making it impossible for this information to be breached.

Professional Practices Management System

PRC's Compliance Officer helps our agency stay informed of all applicable laws, state or federal regulations, and state licensing requirements, as well as managing our Professional Practices Management Systems (PPMS) certification.  PRC has the distinction of being one of the few agencies to obtain PPMS certification.  Only 5% of agencies in the world have obtained a PPMS Certification through the ACA.  This certification demonstrates that PRC is committed to quality control and compliance issues in the collection industry.

Unlike some certifications such as SAS70, which only focus on particular areas, PPMS relates to the overall management of business and covers 18 basic elements, one of which is Information Management Systems & Technical Infrastructure Administration.  Click here to find out more about how PPMS covers all business processes, not just a select few. 

As part of our compliance checking commitment, PRC employs a full time Account Auditor that audits all of our collectors for compliance with state and federal regulations, as well as PRC policies and procedures.

PRC’s Information Technology team is dedicated to protecting the data we receive, transmit, and store while keeping it usable and accessible.  We realize that data security and integrity is vitally important to our business partners, and we are continuously reviewing and strengthening our data policies to meet and exceed industry standards for data security and integrity.
