Additionally, in situations where a personal guarantee is in place and the only avenue for collection of a commercial debt, following the FDCPA now becomes mandatory. All PRC personnel are highly trained in FDCPA law. Few strictly commercial collection agencies are even aware of FDCPA regulations, never mind expert in them. That creates a very real danger for those creditors utilizing those firms, because credit grantors are included in lawsuits for FDCPA violations. This approach is designed to encourage your client to pay you directly, BEFORE it becomes a collection account. For your claims placed less than 110 days from original invoice date, at no cost to you, PRC will send a 10-day free-demand letter on your behalf.
